Overview

These Terms of Service apply to the VYRE online merchandise store at shop.vyrefit.com and to purchases made through that store. The terms “VYRE,” “we,” “us,” and “our” refer to the operator of the store. By accessing the store or purchasing merchandise, you agree to these Terms, our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, do not use the store.

Eligibility and account information

You must be able to enter into a binding agreement where you live. Information supplied during checkout, including contact, billing, payment, and shipping information, must be accurate, current, and complete. You are responsible for activity associated with your account and for safeguarding any account credentials.

Products and availability

We work to display product descriptions, colors, measurements, and images accurately, but screens and production processes can create minor variations. Product availability, specifications, prices, and designs may change without notice. We may limit quantities, discontinue products, or restrict sales by geographic region.

Orders and cancellations

Submitting an order is an offer to purchase. An order is accepted after payment is authorized and we confirm it. We may decline or cancel an order because of availability, pricing or listing errors, suspected fraud, legal restrictions, or other reasonable concerns. Made-to-order production can begin quickly, so cancellation requests are not guaranteed and orders cannot be canceled after fulfillment begins.

Prices, payment, and taxes

Prices are shown in U.S. dollars unless stated otherwise. Shipping and applicable taxes are added at checkout. You authorize us and our payment providers to charge the payment method supplied for the total displayed at checkout. Promotions may have separate terms and may be changed or ended at any time.

Fulfillment, shipping, and delivery

VYRE merchandise is made to order and may be produced, packed, and shipped by a third-party fulfillment partner. Production and delivery dates are estimates and are not guaranteed. Carrier delays and other events outside our reasonable control may affect delivery. Current regions, rates, timelines, tracking details, and claim requirements are described in our Shipping Policy.

Returns and refunds

Returns, replacements, cancellations, and refunds are handled only as described in our Return and Refund Policy. Because merchandise is made to order, returns or exchanges for buyer’s remorse, incorrect size or color selection, or a change of mind are generally not accepted, except where required by applicable law.

Acceptable use

You may not use the store for unlawful, fraudulent, abusive, or harmful activity; interfere with its security or operation; attempt unauthorized access; transmit malicious code; scrape or copy content through automated means without permission; or violate another person’s rights.

Intellectual property

The VYRE name, logos, designs, product artwork, text, graphics, photographs, and store content are owned by or licensed to VYRE and are protected by intellectual-property laws. Store access does not grant a license to reproduce, distribute, modify, sell, or commercially exploit that material without prior written permission.

Third-party services and Shopify

The store is powered by Shopify and may use third parties for payment processing, fulfillment, shipping, analytics, and other functions. Those providers may process information as described in our Privacy Policy. Purchases from this store are transactions directly between you and VYRE; Shopify is not the seller and is not responsible for VYRE products or transactions. Links to third-party sites are provided for convenience, and use of those sites is subject to their own terms and policies.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the store and its content are provided “as is” and “as available.” We do not guarantee uninterrupted, secure, or error-free access. To the fullest extent permitted by law, VYRE will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the store or a purchase. Where liability cannot be excluded, our aggregate liability relating to a merchandise order will not exceed the amount paid for that order. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

Indemnification

To the extent permitted by law, you agree to indemnify and hold VYRE harmless from third-party claims, losses, or expenses resulting from your unlawful use of the store, your violation of these Terms, or your infringement of another person’s rights.

Termination, severability, and waiver

We may suspend or terminate store access for violation of these Terms. If any provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver of that provision.

Changes to these Terms

We may update these Terms by posting a revised version and changing the “Last updated” date. Changes apply prospectively unless the law requires otherwise. Continued use of the store after an update means you accept the revised Terms.

Governing law

These Terms are governed by applicable United States law and the law of the state in which VYRE is established, without limiting consumer protections that apply where you live.
